The case seeks a historic ruling that could forever change Namibia’s stance on cannabis. The legal proceedings request:
Declaration of Invalidity: That the prohibition of cannabis possession and use by adults is unconstitutional.
Repeal of Outdated Laws: Removal of cannabis from the Abuse of Dependence - Producing Substances and Rehabilitation Centres Act 41 of 1971.
Medical Access Reform: Removal of cannabis from Schedule 8 of the Medicines and Related Substances Act, 1965 (Act No. 101 of 1965).
Release of Prisoners: Within 6 months of a ruling in favor of legalization, all individuals incarcerated solely for cannabis possession or use must be freed, and those with mixed convictions must have their sentences reduced accordingly.
Immediate Stay of Prosecution: An order to halt ongoing prosecutions related to cannabis offenses.
Legal Costs Covered: That the state bears the cost of this suit.
Further relief: Any additional rulings in the interest of justice.
