Access to Medicine
Denying a person access to life-improving medicine is a human rights violation according to the 1966 International Covenant on Economic, Social and Cultural Rights (ICESCR) and the Universal Declaration of Human Rights (UDHR).
Constitutional Right
Preventing individuals from using cannabis in the privacy of their own homes runs counter to the freedoms enshrined in the Namibian Constitution.
The landmark case for cannabis legalization in Namibia which was initiated in 2021 is being represented by Kadhila Amoomo Legal Practitioners:

Defendant: Prosecutor General of the Republic of Namibia
The case seeks a historic ruling that could forever change Namibia’s stance on cannabis. The legal proceedings request:
Declaration of Invalidity: That the prohibition of cannabis possession and use by adults is unconstitutional.
Repeal of Outdated Laws: Removal of cannabis from the Abuse of Dependence - Producing Substances and Rehabilitation Centres Act 41 of 1971.
Medical Access Reform: Removal of cannabis from Schedule 8 of the Medicines and Related Substances Act, 1965 (Act No. 101 of 1965).
Release of Prisoners: Within 6 months of a ruling in favor of legalization, all individuals incarcerated solely for cannabis possession or use must be freed, and those with mixed convictions must have their sentences reduced accordingly.
Immediate Stay of Prosecution: An order to halt ongoing prosecutions related to cannabis offenses.
Legal Costs Covered: That the state bears the cost of this suit.
Further relief: Any additional rulings in the interest of justice.
